Desigrocers.com works with local retailers to help our members shop online from local grocery stores in many neighborhoods. We are able to achieve this goal by effectively building relationships with the local retailers and adding certain grocery products to our site.
When becoming a member of the Desigrocers.com program, you agree that you have read, understood, and agreed with our Privacy Policy in its entirety, and consent to be bound by all said Terms and Conditions, including any updates thereto.
Desigrocers.com Program
To assure your orders are placed properly, cookies must be enabled on your web browser and a transaction must take place at one of the local retailer’s page through Desigrocers. After the transaction is complete, the order identification information and any order history is recorded on Desigrocers.com.
Desigrocers.com is not responsible and will not be liable for tracking problems resulting from incorrect usage of the Desigrocers.com site, from disabling cookies, or from any other failure of tracking mechanisms.
For members right and responsibilities, see below section. Members must contact Desigrocers.com by email within seven (7) days of original transaction date for any missing transaction(s) in the member’s account. Desigrocers.com is not responsible for claims for any missing transaction(s) beyond seven (7) days of original transaction date. The email should contain the member’s contact information, including postal address and email address used for the order, local retailer’s name, transaction date/time and transaction total. Desigrocers.com will review and adjust the member’s account within seven (7) days if the transaction is found and the local retailer has provided credits to Desigrocers.com.
Desigrocers.com does not warranty, guarantee, or ensure the quality of any product or service requested from any of the local retailer’s. Desigrocers.com is not responsible for changes to, or discontinuance of any local retailers, or for any effect on accrual of credits caused by such changes or discontinuance.
Member Rights and Responsibilities
Our goal is to bring the local retailers closer to you and therefore our web site contains pricing information and description for various product from many local retailers. Please be aware that we are not responsible for the accuracy or validity of the content or the price listed for the products displayed. We encourage our users to be verify the order details when placing the order and upon collecting the items. In certain occasions we may try to assist our users with any issues arising with their orders; however, it is the member’s responsibility to communicate with the local retailer(s) to resolve dispute with the pricing, quality, quantity, timing of pick-up, and any other issue not mentioned here.
You must be 18 years or older to participate in the program. You must be a legal resident of the United States and maintain a physical address.
You may maintain only a single account in the program at any given time. Any duplicate accounts are subject to cancellation.
No machines, scripts or automated services may be used in the Program. Any attempt to tamper, hack, spoof, copy, modify or otherwise corrupt the administration, security or proper function of any part of Desigrocers.com will result in termination of membership, and bar you from future participation, and may result in legal action.
You agree to provide Desigrocers.com with accurate contact information and keep it updated in order to facilitate the order processing.
Your password and account are personal to you and are non-transferable. You may not allow anyone else to use your password or account. Desigrocers.com is entitled to act on instructions received under your password. Desigrocers.com will not be liable for losses that are incurred through the use of your password by a third party.
You may be taxed on any promotional offers depending on the amount you receive and the tax laws of your federal, state and local jurisdictions. You will be responsible for any and all tax liabilities arising out of your receipt of earnings.
You may cancel your Membership at any time by indicating your cancellation on your account information via an e-mail. Should you decide to cancel your membership or if there is no activity in your account for a period of 12 consecutive months, your account may be assumed inactive and dormant.
Desigrocers.com Rights and Responsibilities
Desigrocers.com reserves the right to revise this Agreement, at its sole and absolute discretion, by updating this posting. The revised terms will take effect the date they are posted on the Desigrocers.com site. Your continued enrollment in the Desigrocers.com program shall be deemed to be your acceptance of the modified terms. Please review these posted terms on a regular basis.
Membership in the Desigrocers.com Program is subject to the Terms and Conditions. Desigrocers.com reserves the right to terminate your Membership for failure to comply with the said Terms and Conditions, any fraud or abuse relating to the order placement, or misrepresentation of any information provided to Desigrocers.com or the local retailers. If your membership is terminated by Desigrocers.com, Desigrocers.com may refuse to pay some or all of the amounts credited to your account if such amounts were credited in violation, or after violation, of these Terms and Conditions or were otherwise unlawfully obtained, including credits earned through any part of the Desigrocers.com Program. Should your account be terminated by Desigrocers.com, you are prohibited from re-enrolling under a new account unless formally invited to do so by Desigrocers.com.
Desigrocers.com utilizes the appropriate industry practices to safeguard the confidentiality of your account information and to prevent unauthorized access, maintain data accuracy, and ensure the correct use of information. However, no data transmitted over the Internet can be 100% secure. Consequently, while Desigrocers.com makes every effort to protect your personal information, any information that you provide to Desigrocers.com or to any 3rd party service providers, it is transmitted at your own risk.
By joining the Desigrocers.com program, you are agreeing to receive Desigrocers.com notification and promotional emails, enewsletters and other email special offers. If you do not wish to receive these emails, you may opt out at any time by selecting “Do not send me great offers from Desigrocers.com” from such e-mails.
By joining the Desigrocers.com program, you agree that you have reviewed and accepted our Privacy Policy. In addition, by joining Desigrocers.com, you have authorized us to receive the transaction summary from local retailers for orders placed on Desigrocers.com. We do not collect or store any means of purchasing information at Desigrocers (credit card, Paypal, etc.), except for what is required to process your order.
As a Desigrocers.com member, you agree to indemnify and hold Desigrocers.com, its parents, subsidiaries, affiliates, officers, directors and employees, harmless from any claim or demand, including reasonable attorney’s fees, made by any third party due to or arising in any way out of your participation in the Desigrocers.com program of any intellectual property or other right of any person or entity, or as a result of any threatening, libelous, obscene, harassing or offensive material contained in any Member communications.
Desigrocers.com reserves the right to immediately terminate the Desigrocers.com Program at any time with notice. You will have thirty (30) days from the date notice of program termination is provided to redeem your credits if, at the date notice of termination is given, your credits equal or exceed $10. Notice of program termination shall be effective upon our sending such notice to the email address you provide to Desigrocers.com during the registration process. To receive payment of your credits you need to respond to the email sent to you by Desigrocers.com regarding verification of your contact information and notification of program termination. Should you not respond to the aforementioned email within 30 days of notification of program termination, you will forfeit any and all credits that remain in your member account. Notification of program termination shall be effective upon our sending such notice to your email address stored in our database.
Any disputes and/or claims arising out of these Terms and Conditions, the use of the Site and/or any products and services acquired under or relating to this agreement shall be resolved exclusively through the use of binding arbitration. Such arbitration shall be subject to the Federal Arbitration Act and the rules of the American Arbitration Association which shall govern such arbitration and be conducted before a single arbitrator in Chicago, Illinois. Any claimants shall have their claims/disputes resolved on an individual basis. Class action arbitration is prohibited under this Agreement. Neither you nor we shall be entitled to join or consolidate claims in arbitration by or against other users or arbitrate any claims as a member of a class or in a private attorney general capacity. We will pay the costs of the arbitrator. Except for the costs of the arbitrator, each party shall bear its own costs, including any attorneys’ fees. Any award rendered in arbitration shall be final and binding, and may be enforced in any court having competent jurisdiction. In addition to any other remedies, we shall also have the right to seek injunctive relief to protect our intellectual property rights in and to our Site.
This Agreement constitutes the entire Agreement between you and Desigrocers.com in connection with general membership in the Desigrocers.com program and supersedes all prior agreements between the parties regarding the subject matter contained herein. If any provision of this Agreement is found invalid or unenforceable, that provision shall be enforced to the maximum extent possible, and the other provisions contained herein will remain in full force and effect. No failure of either party to exercise or enforce any of its rights under these Terms and Conditions will act as a waiver of such rights. Nothing in this Agreement shall be construed as creating or constituting a partnership, joint venture, agency or other like relationship between Desigrocers.com and its partnered local retailers. Neither the local retailers nor any Desigrocers.com Corporate Partner shall have the ability to create obligation on Desigrocers.com’s behalf.
